1. About this Policy
This Refund and Cancellation Policy explains how a YachtCraft Index membership or additional paid service may be cancelled and when a refund may be issued.
YachtCraft Index is operated by:
CraftIndex OÜ
Registry code: 17498820
Legal form: Osaühing, OÜ
Registered address: Pärnu mnt 139b, Kesklinna linnaosa, Tallinn 11317, Harju maakond, Estonia
Email: office@yachtcraftindex.com
In this Policy, CraftIndex OÜ may be referred to as “CraftIndex,” “YachtCraft Index,” “we,” “us,” or “our.”
The company or professional organisation purchasing the service may be referred to as the “Customer,” “Company,” “Applicant,” “Member,” “you,” or “your.”
This Policy forms part of the agreement between CraftIndex OÜ and the Customer and must be read together with:
- the YachtCraft Index Terms and Conditions;
- the Membership and Payment Conditions; and
- any service-specific conditions displayed before purchase.
2. Business-to-business service
YachtCraft Index is strictly a business-to-business service.
Memberships and paid services are offered only to companies, sole traders, professional organisations and persons acting for business purposes.
The consumer right to withdraw from a distance contract does not apply where the Customer is acting exclusively for business or professional purposes.
Any refund right described in this Policy is a contractual business-to-business policy unless a refund is required by mandatory law.
3. Annual membership
The standard YachtCraft Index membership is offered at:
- €29 per month, billed annually at €348; or
- US$32 per month, billed annually at US$384.
The full annual amount is paid in advance.
The monthly figure is a monthly equivalent of the annual price. It does not mean that the membership is paid or refundable month by month.
4. Automatic renewal
Membership automatically renews for successive annual terms unless the Customer cancels before the renewal payment is processed.
CraftIndex OÜ will send a renewal reminder at least 30 calendar days before the scheduled renewal date.
The reminder may include:
- the renewal date;
- the applicable annual price;
- the billing currency;
- any notified price change; and
- instructions for cancelling the renewal.
5. How to cancel
The Customer may cancel automatic renewal at any time before the renewal payment is processed.
Cancellation may be completed:
- through an available Stripe billing or customer portal; or
- by emailing office@yachtcraftindex.com.
An email cancellation request must be received before the renewal payment is processed.
The request should identify:
- the Company name;
- the account email address; and
- the relevant membership or paid service.
CraftIndex OÜ may request reasonable confirmation that the person making the request is authorised to act for the Customer.
6. Effect of cancellation
Cancellation prevents the next automatic renewal.
Cancellation does not immediately terminate the current paid annual term.
After cancellation:
- the membership remains active until the end of the paid term;
- the Company profile may remain visible until that date;
- the Customer may continue using the available membership features;
- any active status or feature continues until its applicable expiry date; and
- no further annual renewal will be charged.
The Customer may ask CraftIndex OÜ to hide its profile before the paid term ends.
Early profile removal does not create a right to a partial refund.
7. No prorated refund after ordinary cancellation
Annual membership fees are not refundable on a monthly, daily or proportional basis following ordinary cancellation.
If the Customer cancels during an annual term:
- the current annual term remains paid;
- the membership continues until the expiry date;
- no refund is issued for unused days or months; and
- cancellation applies only to future renewal.
8. Initial seven-day voluntary refund
The Customer may request a full refund within seven calendar days after the initial membership payment where all of the following conditions are met:
- the Company profile has not been published;
- no additional paid service has been delivered;
- no paid profile-optimisation, profile-writing or similar work has begun or been completed;
- the Customer has not breached the Terms and Conditions; and
- the account is not being rejected, suspended or terminated because of fraud, misleading information, unlawful content or another breach.
The seven-day period begins on the date the initial payment is successfully processed.
The refund request must be sent to:
This seven-day refund is a voluntary business-to-business policy and is not a consumer withdrawal right.
9. Refund where YachtCraft Index rejects the application
Registration and payment provide access to the onboarding and profile-review process.
Payment does not guarantee profile approval or publication.
If CraftIndex OÜ determines that a Company is not eligible and the Company profile has never been published, CraftIndex OÜ will refund the full initial membership fee, provided that the Customer:
- submitted the information reasonably required for review;
- cooperated with the review process;
- responded to reasonable requests;
- provided accurate information; and
- did not breach the Terms and Conditions.
Any additional paid service that has not been activated or delivered will also be refunded.
10. No rejection refund where the Customer prevents review
A rejection refund is not required where approval or publication cannot be completed because the Customer:
- fails to complete the profile;
- abandons the onboarding process;
- fails to provide requested information;
- repeatedly fails to respond to reasonable communications;
- provides false, misleading or materially incomplete information;
- uploads unlawful, infringing or unauthorised content;
- misrepresents its capabilities, certifications or experience;
- breaches the Terms and Conditions;
- creates a fraud, sanctions, security or legal risk; or
- otherwise prevents CraftIndex OÜ from completing the review.
Failure to complete onboarding does not constitute rejection by CraftIndex OÜ.
11. Profile publication
A profile is considered published when CraftIndex OÜ approves it and makes it available to authorised Builder Users within YachtCraft Index.
Once the profile has been published, the standard membership fee is non-refundable except where:
- CraftIndex OÜ charged the Customer incorrectly;
- a renewal was processed after a valid and timely cancellation;
- CraftIndex OÜ permanently discontinues the paid service;
- CraftIndex OÜ removes a compliant Customer for its own operational reasons;
- mandatory law requires a refund; or
- another express provision of this Policy applies.
12. No refund based on commercial results
Membership provides professional visibility and access to the YachtCraft Index service.
It does not guarantee:
- profile views;
- enquiries;
- leads;
- invitations to quote;
- projects;
- contracts;
- sales;
- income;
- profit;
- a particular search position; or
- contact from any specific Builder User.
A refund will not be issued because:
- the Customer receives no enquiries;
- the Customer does not obtain a project;
- an enquiry does not lead to a contract;
- a Builder User does not respond;
- a commercial negotiation is unsuccessful;
- the Customer is dissatisfied with the amount of activity; or
- the Customer expected a different commercial result.
13. Failure to use the service
A refund will not be issued because the Customer:
- does not log in;
- does not complete or update its profile;
- does not upload suitable content;
- does not respond to enquiries;
- does not use available features;
- forgets about the subscription;
- fails to monitor the registered email address; or
- otherwise chooses not to use the service.
The availability of the service, rather than the Customer’s level of use, determines whether the membership has been provided.
14. Voluntary profile removal
The Customer may request that its published profile be hidden before the membership term ends.
Voluntary profile removal:
- does not cancel the agreement automatically;
- does not create a prorated refund;
- does not change the membership expiry date; and
- does not prevent renewal unless the subscription is also cancelled.
The Customer must separately cancel automatic renewal if it does not want the membership to renew.
15. Duplicate and incorrect payments
CraftIndex OÜ will provide an appropriate refund or correction where:
- the same payment was charged more than once;
- an incorrect amount was charged;
- the wrong service was charged because of an error by CraftIndex OÜ;
- a cancelled subscription renewed after a valid and timely cancellation; or
- another confirmed payment-processing error occurred.
The Customer should notify CraftIndex OÜ promptly at:
The notice should include:
- the Company name;
- the account email address;
- the payment date;
- the amount and currency;
- the Stripe receipt or invoice number, where available; and
- an explanation of the suspected error.
16. Renewal charged after cancellation
If a renewal payment is processed after CraftIndex OÜ received a valid cancellation request before the renewal payment was processed, the renewal amount will be refunded.
A refund may be refused where:
- the cancellation request was received after the renewal payment was processed;
- the Customer cancelled a different subscription;
- the request did not reasonably identify the relevant account or subscription and the Customer failed to provide clarification;
- the Customer only removed or changed the payment method without cancelling the subscription; or
- the Customer believed that deleting an email, profile field or account user automatically cancelled the subscription.
17. Failed renewal payments
If a renewal payment fails:
- a seven-calendar-day grace period applies;
- Stripe may retry the payment;
- the Customer may update its payment method; and
- the membership may remain active during the grace period.
If payment remains unsuccessful after seven days, CraftIndex OÜ may suspend the membership and hide the profile.
The Customer will then have a further 30 calendar days to settle the outstanding payment.
If payment remains unpaid after this period, CraftIndex OÜ may terminate the membership.
A failed or reversed payment does not create a refund right because no successfully retained payment exists for the unpaid renewal term.
18. Suspension or termination for breach
No refund is normally issued where the account, profile, membership or additional service is suspended or terminated because the Customer:
- breaches the Terms and Conditions;
- fails to pay;
- provides false or misleading information;
- infringes third-party rights;
- uploads unlawful or confidential material without authority;
- misuses the platform;
- misuses YachtCraft Index branding, certificates or badges;
- creates a security risk;
- engages in fraud or unlawful conduct;
- is subject to applicable sanctions or legal restrictions; or
- damages the integrity or credibility of the index.
This does not affect any right that cannot lawfully be excluded.
19. Removal for operational or commercial reasons
CraftIndex OÜ may permanently remove a compliant Customer for its own operational or commercial reasons.
Where:
- the Customer has not breached the agreement;
- the removal is not caused by non-payment;
- no Customer-specific legal or sanctions restriction applies; and
- CraftIndex OÜ ends the membership before the paid term expires,
CraftIndex OÜ will refund the portion of the membership fee corresponding to the unused full months of the annual term.
No refund will be calculated for a partial month.
20. Platform discontinuation
If CraftIndex OÜ permanently discontinues the paid YachtCraft Index membership service during an active paid term, affected Customers will receive a proportionate refund for unused full months.
No refund is due under this section where:
- only a non-essential feature is changed or removed;
- the platform remains capable of providing its core paid purpose;
- the Customer’s access ends because of breach or non-payment;
- a legal restriction applies specifically to the Customer; or
- the Customer voluntarily requests early removal.
21. Temporary service interruptions
Temporary unavailability does not automatically create a refund right.
The platform may occasionally be unavailable because of:
- maintenance;
- updates;
- hosting issues;
- database issues;
- payment-provider issues;
- security incidents;
- internet failures;
- cyberattacks;
- legal requirements;
- force majeure; or
- circumstances outside CraftIndex OÜ’s reasonable control.
Where a serious and prolonged failure caused by CraftIndex OÜ prevents the Customer from receiving the essential membership service, CraftIndex OÜ may provide an appropriate remedy depending on the circumstances.
A remedy may include:
- an extension of the membership term;
- a service credit;
- a partial refund; or
- another reasonable solution.
22. Additional paid services
CraftIndex OÜ may offer additional paid services, including:
- Verified Company status;
- Spotlight Visibility;
- enhanced visibility;
- profile optimisation;
- profile-writing services;
- priority review;
- certificates;
- analytics;
- insights; and
- other optional services.
The checkout or order description will state whether an additional service is:
- one-time;
- recurring;
- valid for a fixed period;
- dependent on an active membership; or
- subject to separate conditions.
23. Refunds for additional services
An additional paid service will be refunded where:
- it was charged more than once;
- an incorrect amount was charged;
- CraftIndex OÜ cannot provide the purchased service;
- the Company is rejected before publication and the service has not been delivered;
- a recurring service renewed after a valid and timely cancellation; or
- mandatory law requires a refund.
24. Non-refundable additional services
No refund is normally issued where:
- the additional service has been activated;
- profile-optimisation work has begun;
- profile-writing or editorial work has begun;
- the Customer has approved or received the completed work;
- visibility has already been provided;
- a certificate has been generated;
- the Customer does not obtain a commercial result;
- the Customer voluntarily stops using the service;
- the underlying membership is suspended because of breach;
- the Customer submitted inaccurate information; or
- the service cannot continue because of the Customer’s conduct.
Where a service involves customised work, the amount refundable may be reduced to reflect work already completed.
25. Verified Company status
Verified Company status, where offered, confirms only the verification status expressly described by CraftIndex OÜ.
It does not guarantee:
- Company quality;
- project performance;
- financial standing;
- legal compliance;
- technical compliance;
- certification validity;
- enquiries; or
- contracts.
A Customer is not entitled to a refund merely because Verified Company status does not result in a commercial opportunity.
If Verified status is withdrawn because the Customer supplied inaccurate information or no longer satisfies the stated criteria, no refund is normally due.
26. Spotlight and enhanced visibility
Spotlight Visibility, enhanced visibility and similar services may affect how a Company profile is displayed.
They do not guarantee:
- first position in all searches;
- permanent priority;
- a minimum number of views;
- a minimum number of enquiries;
- a commercial opportunity; or
- exclusivity.
A lack of enquiries or views does not create a refund right where the purchased visibility feature was made available as described.
27. Price changes
CraftIndex OÜ may change membership or additional-service prices for future renewal periods.
A price increase:
- does not affect the current paid term;
- will apply only from a future renewal;
- will be communicated at least 30 calendar days before it is charged; and
- may be avoided by cancelling before renewal.
A Customer who does not accept the new price must cancel before the renewal payment is processed.
A price change does not create a refund right for the current paid term.
28. Currency and exchange rates
Refunds are issued in the currency originally paid.
CraftIndex OÜ is not responsible for:
- changes in exchange rates;
- conversion charges;
- foreign-transaction charges;
- payment-card charges;
- bank fees; or
- differences between the amount originally converted by the Customer’s bank and the amount converted when the refund is received.
The amount refunded by CraftIndex OÜ will not exceed the amount originally received for the relevant payment.
29. Refund method
Approved refunds will normally:
- be processed through Stripe;
- be returned to the original payment method;
- be issued in the currency originally paid; and
- be limited to the amount paid for the relevant service.
CraftIndex OÜ may request additional information where necessary to identify the payment or prevent fraud.
Where the original payment method cannot receive the refund, CraftIndex OÜ and the Customer may agree on another lawful method.
30. Refund processing time
CraftIndex OÜ will process an approved refund within a reasonable period.
After CraftIndex OÜ submits the refund to Stripe, the time required for the amount to appear in the Customer’s account depends on:
- Stripe;
- the card network;
- the Customer’s bank;
- the payment method; and
- the country in which the payment method was issued.
CraftIndex OÜ is not responsible for delays caused by the payment provider or financial institution after the refund has been submitted.
31. Chargebacks
The Customer should contact CraftIndex OÜ before initiating a chargeback where it believes a payment was incorrect.
A chargeback does not automatically constitute valid cancellation.
Where a chargeback or payment dispute is initiated, CraftIndex OÜ may provide the payment provider with relevant records, including:
- registration information;
- payment authorisation;
- accepted Terms;
- subscription details;
- renewal reminders;
- cancellation records;
- account activity;
- profile publication status;
- service-delivery records; and
- communications.
CraftIndex OÜ may suspend the account while a chargeback is being investigated.
Fraudulent or abusive chargebacks may result in permanent termination and refusal of future service.
32. Account closure and data retention
Cancellation prevents future renewal but does not immediately delete the account or profile data.
When membership ends:
- the profile is hidden from Builder Users;
- inactive profile data and uploaded content are normally retained for 90 days;
- after 90 days, profile content may be deleted or anonymised;
- backup copies may remain for a further maximum of 90 days;
- accounting, payment and contractual records may be retained for seven years or another legally required period; and
- security, fraud-prevention, unsubscribe and dispute records may be retained for as long as reasonably necessary.
A request to delete profile data does not remove records that CraftIndex OÜ must retain by law or reasonably needs to establish, exercise or defend legal claims.
33. Cancellation confirmation
Where cancellation is completed successfully, CraftIndex OÜ or Stripe may send a confirmation email.
The Customer should retain this confirmation.
If the Customer does not receive confirmation, it should verify the subscription status through the billing portal or contact:
The Customer remains responsible for ensuring that the cancellation was submitted for the correct subscription.
34. Changes to this Policy
CraftIndex OÜ may update this Policy to reflect:
- legal or regulatory changes;
- changes to membership services;
- changes to Stripe or payment processes;
- new additional services;
- fraud-prevention requirements;
- operational changes; or
- clarification of existing rules.
Material changes affecting active subscriptions will normally be communicated in advance.
Changes will not retrospectively remove a refund right that had already arisen under the version applicable when the relevant payment or event occurred.
35. Governing law
This Policy and all refund and cancellation matters are governed by the laws of the Republic of Estonia.
Mandatory legal rights that cannot lawfully be excluded remain unaffected.
36. Disputes
Before beginning legal proceedings, the Customer should send a written complaint to:
The complaint should include:
- the Company name;
- the account email address;
- the relevant payment;
- the date, amount and currency;
- the reason for the complaint;
- the requested resolution; and
- supporting documents.
The parties should attempt in good faith to resolve the matter through written communication.
Unresolved disputes are subject to the jurisdiction provisions in the YachtCraft Index Terms and Conditions.
